1. The renewal application should be filed within the 12-month prior to the expiry date in India.
In accordance with the regulations of the Indian Trademark Act, if the owner of a registered trademark fails to file an application or pay the prescribed fee in the prescribed manner within the renewal due date, the Registrar of Trademarks may remove the trademark from the register. However, if an application is made in the prescribed manner and the prescribed fee and additional fee are paid within six months from the expiration of the registration period, the Registrar of Trademarks shall renew the registration of the trademark for ten years in accordance with Article 25(2). If a trademark is removed due to non-payment of the prescribed fee, and the Registrar of Trademarks receives an application submitted in the prescribed manner and payment of the fee within one year after the expiry of the last registration period, and deems it appropriate to do so, the Registrar shall restore the trademark to the register without any conditions or with any appropriate conditions or restrictions, and renew the registration of the trademark for ten years from the date of the last registration period.
2. Renewal certificate for Indian trademark can be obtained around 2-3 months from the date of filing.
