1. All or Nothing Rule in Mainland China (Assignment)
According to Article 42 of Trademark Law and Article 31 & 32 of Implementing Regulations of the Trademark Law: the Assignor shall assign in a lump all of its identical or similar trademarks, including IR marks, in respect of the same or similar goods/services to assignee.
2. Documents required for Assignment Application in China:
1) POA executed by Assignor;
2) Official identification document of assignor, such as Certificate of Good Standing, passport, ID card etc.;
3) POA executed by Assignee;
4) Official identification document of Assignee, such as Certificate of Good Standing, passport, ID card etc.;
5) Assignment agreement executed by both parties.
*Note: In case the assignor ceases operations, the Power of Attorney and the Good Standing Certificate can be exempted. However, official documents proving that the assignor no longer exists must be provided.
