Trademark Renewal Application in The Philippines

1.     The renewal application should be filed during the 6-month period prior to the expiry date. Please note that as the trademark regulations of the Philippines, the renewal application may be filed during the six-month grace period after the expiry date subject to the payment of a surcharge equivalent to 50% of the renewal fees. Based on IPOPHIL MEMORANDUM CIRCULAR NO. 17-010, the registrant needs to file a RENEWAL DAU within one year from the expiration date. Failure to file the said DAU within the said period will result in the automatic cancellation of the subject registration.

2.  Renewal certificate for the Philippines trademark will be issued in around 5-7 months from the date of filing.

3.  Hard copy of Renewal certificate(s) will be issued.

4.     Documents required for renewal Application in the Philippines: 1) Signed POA (power of attorney), origin/notarization/legalization is not required; 2) RENEWAL DAU

 Philippine Peso is used locally in the Philippines, but the invoice will be issued in US dollars. The above quotation is for reference only, the actual cost will be based on the fee actual incurred and the exchange rate at that time;

 Please note that the above fees do not include VAT and bank charges if any;

 Estimated costs of professional fees for filing a response to office action by submitting additional proof of use are USD110 in total (USD 10 for Disbursement);

 If the address needs to be changed, the foreign agency Counsel fee for the trademark is USD 85, and the official fee is USD 17;

 It is highly recommend that filing the renewal of registration simultaneously with the Renewal DAU to save cost on the out of pocket expenses as the foreign agent will charge only one disbursement for the two activities.
